LESSOR HEREBY RENTS TO HIRER(S) TAKES ON RENTAL THE MOTOR VEHICLE DESCRIBED OVERLEAF, OR ANY SUBSTITUTED VEHICLE (HEREIN CALLED VEHICLE) SUBJECT TO ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT.
1. Deposit (Kaution)
A returnable bond of £500 will be levied and returned providing that hirers will return the vehicle together with all tyres, tools, accessories and equipment in the same condition as when received, normal wear and tear expected, to the place and on the date and time specified on the agreement or sooner if demanded by the lessor and will use vehicle in a reasonable manner.
(Es wird eine Kaution von £ 350,- vor Ort fällig, die zurückgezahlt wird, wenn das Fahrzeug ordnungsgemäß, mit allen Teilen und rechtzeitig zurückgegeben wird.)
2. Availability (Verfügbarkeit)
If the vehicle is not available for reasons beyond our control we reserve the right to substitute a vehicle of similar category or refund all payments without further liability.
(Sollte ein Fahrzeug trotz Mietvertrages aus Gründen, die der Vermieter nicht zu vertreten hat, nicht mehr zur Verfügung stehen (z.B. hatte der Vormieter einen Unfall), hat der Vermieter das Recht, ein anderes Fahrzeug herauszugeben oder den Mietpreis ohne weitere Entschädigung zu erstatten.)
3. Deposit (Anzahlung)
A 25% deposit to reserve the vehicle is required when booking.
(Es ist eine Anzahlung von 25% des Mietpreises bei Buchung zu entrichten. Hinweis: Britain Travel nimmt nur eine Kaution von 20%.)
4. Cancellations/refunds (Stornierungen, Rückzahlungen)
On confirming the booking loss of deposit. Up to 8 weeks before the start of the hire 50% of hire charge, Up to 5 weeks before the start of hire 75% of hire charge, Up to 4 weeks before full hire charge to be paid.
(Nach der Bestätigung der Buchung verfällt bei Stornierung die Anzahlung. Stornierungskosten: bis 8 Wochen: 50%, bis 5 Wochen: 75%, bis 4 Wochen vor Beginn des Buchungszeitraumes: 100% Stornogebühr.)
5. Vehicle will not be used for (das Fahrzeug darf für folgende Fälle nicht benutzt werden)
a) For the carriage of passengers for hires for reward. (Kommerzieller Personentransport)
b) Knowingly for any unlawful purpose. (Bekanntes unrechtmäßiges Verhalten)
c) To propel or tow any other vehicle or trailer. (Ein anderes Fahrzeug oder Anhänger ziehen oder schieben.)
d) For racing, pacemaking, reliability trials, speed testing or driver tuition. (Für Rennen, Rallyes, Geschicklichkeitsfahren, Geschwindigkeitstests oder Fahrschulunterricht.)
e) To carry a greater number of passengers and/or more baggage than recommended by the manufacturer. (Mehr Passagiere und Gepäck als erlaubt zu transportieren.)
f) By any person who has given a fictitious or false name. (Der Fahrer darf keinen falschen Namen verwenden.)
g) By any person other than the hires who signed the rental agreement or who has been nominated as a driver by the hirer and approved by lessor or by a motor vehicle repairer in the event of an accident or breakdown. (Es dürden nur angegebene Fahrer das Fahrzeug fahren.)
h) By any person who has within the proceeding period of three years been convicted of any motoring offenses, except parking offenses, or involved in any accident unless details have been disclosed to lessor. (Fahrer dürfen innerhalb der letzten drei Jahre nicht wegen Verkehrsvergehen angeklagt worden sein.)
i) By any person not holding a valid current driving license for at least two years. (Die Fahrer müssen eine gültige Fahrerlaubnis besitzen.)
j) By any person under 25 years of age and over 70 years of age. (Fahrer müssen zwischen 25 und 70 Jahre alt sein.)
k) By any person who is under the influence of drink. (Fahrer dürfen nicht betrunken fahren.)
6. Additional costs (Zusatzkosten)
Hirer expressly acknowledges personal liability to pay lessor on demand (Der Mieter erkennt ausdrücklich folgende möglichen zusätzlichen Forderungen an)
a) Time, collision damage weaver and miscellaneous charges at the rates specified in this agreement. (Versicherungsgebühren)
b) All fines and court costs for parking, traffic or other offenses incurred in relation to said vehicle by hirer or lessor from commencement of this agreement until vehicle is returned except where caused through fault of lessor. (Verkehrsstrafen)
c) Lessor’s cost, including reasonable legal fees incurred collecting payment due from hirer hereunder. (Inkassogebühren)
d) Lessor’s cost to repair collision or other damage to vehicle provided, however vehicle is operated in accordance with all the terms hereof, hirer’s liability for each damage. (Unfallschäden, Versicherungen)
di) Shall not exceed the maximum liability of £ 1,500 for each and every accident. (Vollkaskoschäden sind auf £ 1500,- begrenzt, Selbstbeteiligung)
dii) Shall be reduced to £ 500.00 if the hirer has purchased the collision damage weaver of excess as evidenced by his initials in the accepts space provided on this agreement. (Mit Zusatzversicherung kann die Selbstbeteiligung auf £ 350,- reduziert werden.)
diii) Damage to the interior of the vehicle is not covered by insurance and is the responsibility of hirer. (Schäden an der Einrichtung des Fahrzeuges sind nicht versichert.)
die) Damage to tyres and road wheels is not covered by insurance and is the responsibility of hirer. (Schäden an Reifen, Rädern sind nicht versichert.)
iv) Punctures are responsibility of hirer. (Luftverlust/Plattfuß am Reifen muss vom Mieter bezahlt werden.)
7. Information of lessor (Benachrichtigung des Vermieters)
Hirer must inform lessor immediately, including on public holidays, of any loss or damage occurring to vehicle and of any fault which makes vehicle unroadworthy or liable to cause danger to any person or property use vehicle until such damage or fault has been repaired or corrected. Authorisation for expenditure must be obtained from lessor prior to commencement of the repair. (Jeder Schaden am Fahrzeug muss sofort, auch an Feiertagen, sofort dem Vermieter mitgeteilt werden. Reparaturen können vom Mieter nur mit Genehmigung des Vermieters in Auftrag gegeben werden.)
8. Breakdown compensation (Fahrzeugschaden Ersatzleistung)
In the event of a breakdown or accident Lothian Caravanette Hire is not liable for hotel charges. Our liability will be limited to the provision of a replacement vehicle or return or hire charges for days lost, the decision being at Lothian’s discretion. (Im Falle eines Fahrzeugschadens haftet der Vermieter (Lothian Caravanette Hire = Lothian Motorhome Hire) nicht für Folgekosten wie Hotelübernachtungen. Es wird lediglich ein Ersatzfahrzeug gestellt oder die Mietgebühren erstattet.)
9. Liabilty for hirer's property. (Haftung für Mietereigentum)
Lessor shall not be liable for loss or damage any property left, stored or transported by hirer or any other person in vehicle either before or after the return to lessor. Hirer hereby agrees to hold lessor harmless from and indemnify lessor against all claims based upon or arising out of such loss of damage.
10. Hirer's duties for insurance (Aufgaben des Versicherungsnehmers)
Hirer participates as an insured under a comprehensive motor vehicle insurance policy which is available for inspection by hirer at the head office of Lester. Hirer agrees further to protect the interest of lessor and lessor’s insurance company in case of accident during the term of rental by: (Der Versicherungsnehmer hat sich im Versicherungsfall folgendermaßen zu verhalten)
a) Making every endeavor to obtain names and address of parties involved and of witnesses. (Alle Anstrengungen zu unternehmen, die Namen und Adressen der Unfallbeteiligten und Zeugen aufzunehmen)
b) Not admitting liability or guilt. (Keine Schuld zugeben)
c) Not abandoning vehicle without adequate provisions for safely guarding and securing same. (Das Fahrzeug nicht ohne Absicherung hinterlassen)
d) Calling nearest office or lessor by , phone even in case of slight damage: further giving a detailed report, including diagram to lessor. (Den Vermieter auch im Falle von kleinen Schäden sofort informieren)
e) Notifying the police immediately if another parties guilt has to be ascertained or if people are injured. (Sofort die Polizei hinzuziehen)
11. Hire extentions (Verlängerung der Vermietung)
Any extensions on the hire of the vehicle must be notified to lessor immediately and personally. Failure to do so means that the driver is driving the vehicle without insurance cover against Police Regulations. (Jede Verlängerung des Wohmobilmietzeitraumes muss mit dem Vermieter persönlich abgesprochen werden. Andernfalls ist das Fahrzeug nicht mehr vermietet.)
UNAUTHORISED LATE RETURNS WILL BE CHARGED AT £ 500.00 PER DAY OR PART THEREOF. (Jede unabgesprochene verspätete Rückgabe des Fahrzeuges kostet £ 500,- pro Tag)
12.Vehicle standard (Ausstattung und Wartung des Fahrzeuges)
Lessor has maintained vehicle to at least the manufacture’s recommended standards but shall not be liable for any consequences arising from any defects or mechanical failure of the vehicle although all reasonable precautions have been taken to prevent such happenings. (Das Fahrzeug ist entsprechend dem Standard des Herstellers ausgestattet und wird entsprechend gewartet. Aus diesem Grunde haftet der Vermieter nicht für Schäden oder mechanische Defekte, die dennoch entstehen)
13.Fuels (Kraftstoffe)
Diesel, petrol, oil and gas are at hirer’s expense. We operate an empty out empty in system with diesel/ petrol. (Kraftstoffe gehen zu Lasten des Mieters. Das Fahrzeug wird leer übergeben und soll auch leer zurückgebracht werden.)
14. Addional clauses (Zusatzbedingungen)
That additions to or alterations of the terms and conditions of this agreement shall be null and void unless agreed upon in writing by parties. (Zusätzliche Bedingungen und Änderungen bedürfen der Schriftform)
15. Hire dates (Vermietungszeiträume)
Hire dates are Friday to Friday unless by prior arrangement. (Das Fahrzeug wird immer von Freitag bis Freitag vermietet, wenn nicht anders abgesprochen)
Britain Travel ist lediglich Vermittler dieser Wohnmobile. Es gilt der englische Bedingungstext, die deutsche Übersetzung ist nur sinngemäß und nicht wörtlich.
